This article focuses on the location of the duty of loyalty—a unique legal norm in Common Law jurisdictions—both actual and desirable, on the continuum between rules and standards. A rule is a relatively ‘closed’ technical norm, at a high level of specificity; it requires little judicial discretion. A standard is an ‘open’ norm, with a greater degree of flexibility, that requires the exercise of discretion. The insights from this jurisprudential perspective are used to reveal the preferred way for further developing (...) the duty of loyalty. The article explains that ‘loyalty,’ intuitively classified as a ‘pure’ standard, has been reconstructed over time as more specific rules. Moreover, it suggests that, ideally, this movement should continue; namely, when applying loyalty to a specific case, courts should include informative content that would promote predictability. It then illustrates that, unfortunately, this road is not always taken by the courts. A decision to retain loyalty as an ad hoc standard, or an inverse attempt to delineate the boundaries of this norm, has implications on the certainty, consistency, and ethical content of the law. The Drosophila tracheal system is a branched tubular structure that supplies air to target tissues. The elaborate tracheal morphology is shaped by two linked inductive processes, one involving the choice of cell fates, and the other a guided cell migration. We will describe the molecular basis for these processes, and the allocation of cell fate decisions to four temporal hierarchies. First, tracheal placodes are specified within the embryonic ectoderm. Subsequently, branch fates are allocated within the tracheal placodes, prior to migration. (...) Localized presentation of the FGF ligand, Branchless, to tracheal cells that express the FGF receptor, Breathless, guides migration. Once cell migration is initiated, distinct cell fates are determined within each migrating branch. Finally, inhibitory feedback mechanisms ensure the correct assignment of these fates. Scaling of pattern with size has been described and studied for over a century, yet its molecular basis is understood in only a few cases. In a recent, elegant study, Inomata and colleagues proposed a new model explaining how bone morphogenic protein (BMP) activity gradient scales with embryo size in the early Xenopus laevis embryo. We discuss their results in conjunction with an alternative model we proposed previously. The expansion‐repression mechanism (ExR) provides a conceptual framework unifying both mechanisms. Results of (...) Inomata and colleagues implicate the chordin‐stabilizing protein sizzled as the expander molecule enabling scaling, while we attributed this role to the BMP ligand Admp. The two expanders may work in concert, as suggested by the mathematical model of Inomata et al. We discuss approaches for differentiating the contribution of sizzled and Admp to pattern scaling. The book Chronicle of Separation is an attempt to write on Derrida, to Derrida and from Derrida on the basis of a pathetic experience, which, in various ways, describes and enacts the pathetic experience of deconstruction itself. The book tackles the weight of emotions that is at the heart of deconstructive reading, treating deconstruction's weak, fragile and parasitic mode of thinking as a deconstruction of emotion, on emotion and as emotion. Chronicle of Separation examines these themes beginning with a descriptive (...) and an analytic reading of Derrida's Memoirs: For Paul de Man and The Post Card, as embodiments of deconstruction's melancholic friendship which inscribes its disillusioned love in what it calls the 'postal condition'. The book then moves on to a feminization of Derrida, experimenting in different modes of writing. It firstly discusses Fred Zinneman's film Julia about a mournful friendship between women. Then it performs a deconstructive meditation on the anorexic person suggesting that anorexia constitutes a paradoxical embodiment of deconstruction. The concluding chapter presents a complete incorporation of Derrida into a fictional text that re-writes the biblical Book of Ruth. (shrink)

The essay examines Scholem's letter-confession on the Hebrew language addressed to Rosenzweig from two perspectives hitherto ignored in the ongoing interpretative consideration of this document: Scholem's repression of the literary space and his consequent exclusion of madness. The essay follows several threads in Derrida's own ‘internal’ reading of the letter, and leans on other Derridean writings such as The Monolingualism of the Other, Schibboleth: For Paul Celan and ‘Cogito and the History of Madness’ in order to suggest two distinct encounters (...) between Derrida and Scholem: In the first encounter, Scholem reads Derrida and proves to be deconstructing his own notions of secular and profane Hebrew, while fighting in vain for his sanity by clinging to liturgical practices against the grain of an ongoing ‘actualization’, politicization or else fictionalization of the sacred language. In the second encounter, it is Derrida who reads Scholem. By transforming the particular conditions of possibility of Hebrew into general conditions of possibility of every language contaminated by a theological-political tension, Derrida contributes some important insights for contemporary Hebrew speakers. This article describes the feasibility of researchinto the relation between values of farmers andsustainability for the Dutch Ministry of Agricultureand the Dutch Federation of Agricultural andHorticultural Organisations.Firstly, a theoretical framework describes differentlevels of motivation behind conduct and choices. Itenables exploration and analysis of individualinterviews with small groups of conventional andecological farmers. The aim is to find out what theirbasic convictions regarding nature and sustainabilityare, and to analyze the relation between theseconvictions and the actual choices they make in theirfarming practice. The (...) research shows that for somefarmers, differences in farming practice go back to themotivation level of moral convictions about what is`good farming'. Purposeful infection of healthy volunteers with a microbial pathogen seems at odds with acceptable ethical standards, but is an important contemporary research avenue used to study infectious diseases and their treatments. Generally termed ‘controlled human infection studies’, this research is particularly useful for fast tracking the development of candidate vaccines and may provide unique insight into disease pathogenesis otherwise unavailable. However, scarce bioethical literature is currently available to assist researchers and research ethics committees in negotiating the distinct issues raised by (...) research involving purposefully infecting healthy volunteers. In this article, we present two separate challenge studies and highlight the ethical issues of human challenge studies as seen through a well-constructed framework. Beyond the same stringent ethical standards seen in other areas of medical research, we conclude that human challenge studies should also include: independent expert reviews, including systematic reviews; a publicly available rationale for the research; implementation of measures to protect the public from spread of infection beyond the research setting; and a new system for compensation for harm. We hope these additions may encourage safer and more ethical research practice and help to safeguard public confidence in this vital research alternative in years to come. (shrink)

Background Voluntary assisted dying became lawful in Victoria, the first Australian state to permit this practice, in 2019 via the Voluntary Assisted Dying Act 2017 (Vic). While conscientious objection by individual health professionals is protected by the Victorian legislation, objections by institutions are governed by policy. No research has been conducted in Victoria, and very little research conducted internationally, on how institutional objection is experienced by patients seeking assisted dying. Methods 28 semi-structured interviews were conducted with 32 family caregivers and (...) one patient about the experience of 28 patients who sought assisted dying. Participants were interviewed during August-November 2021. Data from the 17 interviews (all with family caregivers) which reported institutional objection were analysed thematically. Results Participants reported institutional objection affecting eligibility assessments, medication access, and taking the medication or having it administered. Institutional objection occurred across health settings and was sometimes communicated obliquely. These objections resulted in delays, transfers, and choices between progressing an assisted dying application and receiving palliative or other care. Participants also reported objections causing adverse emotional experiences and distrust of objecting institutions. Six mediating influences on institutional objections were identified: staff views within objecting institutions; support of external medical practitioners and pharmacists providing assisted dying services; nature of a patient’s illness; progression or state of a patient’s illness; patient’s geographical location; and the capability and assertiveness of a patient and/or caregiver. Conclusions Institutional objection to assisted dying is much-debated yet empirically understudied. This research found that in Victoria, objections were regularly reported by participants and adversely affected access to assisted dying and the wider end-of-life experience for patients and caregivers. This barrier arises in an assisted dying system that is already procedurally challenging, particularly given the limited window patients have to apply. Better regulation may be needed as Victoria’s existing policy approach appears to preference institutional positions over patient’s choice given existing power dynamics. (shrink)

Walter Sinnott-Armstrong argues, on the relationship between individual emissions and climate change, that “we cannot claim to know that it is morally wrong to drive a gas guzzler just for fun” or engage in other inessential emissions-producing individual activities. His concern is not uncertainty about the phenomenon of climate change, nor about human contribution to it. Rather, on Sinnott-Armstrong’s analysis the claim of individual moral responsibility for emissions must be grounded in a defensible moral principle, yet no principle withstands scrutiny. (...) I argue thatthe moral significance of individual emissions is obscured by this critique. I offer a moral principle, the threshold-contribution principle, capable of withstanding Sinnott-Armstrong’s criticisms while also plausibly explaining what’s wrong with gas-guzzling joyrides and other gratuitous emissions-producing individual acts. Existing regulation of end-of-life care is flawed. Problems include poorly-designed laws, policies, ethical codes, training, and funding programs, which often are neither effective nor helpful in guiding decision-making. This leads to adverse outcomes for patients, families, health professionals, and the health system as a whole. A key factor contributing to the harms of current regulation is a siloed approach to regulating end-of-life care. Existing approaches to regulation, and research into how that regulation could be improved, have tended to focus on (...) a single regulatory instrument (e.g., just law or just ethical codes). As a result, there has been a failure to capture holistically the various forces that guide end-of-life care. This article proposes a response to address this, identifying “regulatory space” theory as a candidate to provide the much-needed holistic insight into improving regulation of end-of-life care. The article concludes with practical implications of this approach for regulators and researchers. (shrink)

This article provides a conceptual map of the affective terrain while focusing on enduring positive affective attitudes, such as love and happiness. The first section of the article examines the basic characteristics of affective attitudes, i.e., intentionality, feeling, and dispositionality, and classifies the various affective attitudes accordingly. An important distinction in this regard is between acute, extended, and enduring affective attitudes. Then a discussion on the temporality of affective attitudes is presented. The second section discusses major mechanisms that enable long-lasting (...) affective attitudes to endure. These mechanisms include, Hedonic adaptation, which reduces affective intensity, thereby enabling adaptation to a stable, average level of affective intensity; Positive mood offset, which maintains a moderate level of positive mood in the absence of adverse stimuli; The enduring mood of being dissatisfied, thereby keeping the agent’s interest high, and Meaningful development, which underlies the continuation and enhancement of the affective attitude. Each of these mechanisms sustains, in its own unique way, the balance required for enduring affective attitudes. The third section applies the above considerations to two major enduring positive affective attitudes: the mood of lasting happiness and the enduring emotion of profound romantic love. Time is typically a necessary condition for the creation and enhancement of such love. However, it is not a sufficient condition. So only in some cases, but not in all, does loving longer mean loving more. (shrink)
